SuperSaver Holdings UK Limited and its subsidiaries

The following terms and conditions relate to the sign up of consumers and businesses of utilising the free to download SuperSaver App and the features, functionality of them. It also covers the collection and use of both business, transactional and personal data for the operation of the scheme in relation to Vouchers and Loyalty points and other promotional offers and services. SuperSaver Holdings UK Ltd (SSHUKL) will at all times respect the personal data of consumers, and will never use or sell such data to any third parties. In this regard,  for the purpose of the Data Protection Act 1998 (the Act) and the EU General Data Protection Regulation (GDPR), SuperSaver Holdings UK Ltd of Military House, 24 Castle St, Chester CH1 2DS  (registered in England and Wales with company number 11662630) is the data controller in respect of any Personal Data processed by LPL. As data controller, SSHUKL , determines the purposes for which and the manner in which your Personal Data is, or is to be, processed. In these T&C’s and policy SSHUKL describes the types of processing it may undertake with respect to your data.

 

DEFINITIONS:

 

SSHUKL; we are the company that owns, manages the Voucher and loyalty rewards programmes under a Membership umbrella. We provide the platform, technology and interfaces (the Application) between the App, web and Businesses (Traders) in order for the Membership to effectively operate and manage the transactions and data that flow securely between the parties. 

 

Consumer; an individual who downloads the SuperSaver App from any of the Android or IoS-Cloud platforms to a smartphone, and utilises the Vouchers, business services and other offers as contained and/or promoted via the app and linked web site that are of benefit to the consumer. By consenting to the Terms and Conditions contained herein, you will be part of a Membership Agreement that links you, us and the subscribing businesses to the scheme.

 

Businesses; we refer to them as ‘Traders’ to cover the wide variety of types of businesses and services offered. The Traders that appear on the App and/or the web site have subscribed to SSHUKL range of marketing and professional services to promote their business and special and often personalised offers to SSHUKL consumers utilising the app.

 

Upon agreement of these terms and payment of your subscription, you will be bound by the data protection and GDPR regulations as in force at the point of signing and as amended from time to time. The data can only be used in conjunction with SSHUKL, for the purposes and intention originally collected.

 

Trader as data controller

The Trader will also be data controller in common with SSHUKL In subscribing for the Customer Vouchers and special Loyalty Rewards.  As a consumer and subscriber to the App, you have freely given your specific, informed and unambiguous consent to receive marketing communications from the Trader regarding the Trader’s products, services, Vouchers, offers, loyalty rewards and other information which the Trader believes may be of interest to you.

 

In addition, you may have supplied the Trader directly with Personal Data and consented to the Trader’s use of that data for purposes which are connected with the performance of the Membership Agreement or the administration of the Customer Loyalty Rewards. This data is to be distinguished from the data SSHUKL  has collected from you. For example, you may have agreed to the Trader’s collection, use, transfer and storage of your data for the Trader’s own business purposes including credit checks, administration of contractual arrangements, sales and marketing. You should request and check the terms of the Trader’s own privacy policy in these circumstances.  SSHUKL is not liable in respect of any data which is controlled by the Trader or any data which is processed by the Trader outside the scope of the permissions granted by you under the terms of this policy or the Membership Agreement.

 

FURTHER DEFINITIONS:

In this policy, the following definitions are used:

 

Application: means a software application, the platform and Web site interface by which the Member registers for the Voucher and Loyalty Rewards.

SuperSaver Vouchers and Loyalty Rewards: means the customer Voucher and  loyalty rewards programme(s) to which you have subscribed (a) in respect of a specific Trader; and/or (b) with SSHUKL  more generally.

Member/You: means you, a customer who has (a) subscribed for the Voucher and Loyalty Rewards on the SSHUKL  website directly; or (b) via a Trader’s browser access; or via the appropriate App download platform.

Personal Data: means any information relating to an identified or identifiable natural person.

Trader: means the third party trader (business) on whose behalf SSHUKL  administer the SuperSaver Voucher and Loyalty Rewards.

Transaction: means a point of sale purchase made by a Member with an enrolled payment card with either SSHUKL directly and/or a Trader.

Transaction Data: means data supplied via a Payment Provider relating to a Transaction including the following: Merchant ID; card token; date; time; and amount.

 

INFORMATION SSHUKL COLLECTS FROM YOU

SSHUKL will collect and process the following data about you:

Information you give SSHUKL. This is information about you that you give SSHUKL by: Subscribing for the SuperSaver and Loyalty Rewards by entering your details on an App, tablet or other electronic device in a secure web environment from your own device and location (generic sign up) and/or Trader’s store or premises, via a browser to the SSHUKL website and/or via the ‘local area web site. This information may be completed by you or by a representative of the Trader on your behalf. Subscribing for the Voucher and Loyalty Rewards by entering your details on the Trader’s website. In doing so, you are providing SSHUKL with the information required to complete your subscription to the Voucher and Loyalty Rewards. Authorising the transfer/migration of data and information relating to you already held by the Trader (or any other organisation which may be administering a Voucher and loyalty Rewards on the Trader’s behalf) to SSHUKL so that SSHUKL may administer the Voucher and  Loyalty Rewards. Subscribing for the SuperSaver Voucher and Loyalty Rewards by entering your details on an Application whether on or off the Trader’s premises. 

 

The information you give SSHUKL may include your name, address, e-mail address and phone number, personal description and photograph, and other information which is necessary for the administration of the Voucher and Loyalty Rewards.

Information SSHUKL  collect about you. Whenever you access the Application or make use of the loyalty App issued in relation to the Voucher and Loyalty Rewards Programme, SSHUKL will automatically collect the following information: technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, and your login information; information about your visit, via our cookie policy, Information SSHUKL may receive from other sources. This is information SSHUKL may receive about you if you use any other applications, services or websites SSHUKL provide. In such cases SSHUKL  will inform you when SSHUKL  collects that data if SSHUKL intends to share the data internally and combine it with data collected from you when you subscribed for the Voucher and Loyalty Rewards. SSHUKL  will also tell you the purposes for which we may share and combine your data. SSHUKL  works closely with third parties (including, for example, banks, credit card companies, Traders, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies). SSHUKL will notify you when it receives information about you from them and the purposes for which SSHUKL intends to use that information.

 

CONSUMER SPECIFIC TERMS & CONDITIONS

 

The Use of Vouchers:

  1. There can be only one voucher per order, per person, unless the Trader and/or the voucher offer states differently.

  2. Vouchers do not carry any convertible currency value on their own and are non-refundable and cannot be exchanged for cash.  Specific terms and conditions of use regarding voucher validity are contained on/or with each voucher.

  3. Vouchers can only be used if a minimum order amount is met (excluding any and all carriage or postage costs). The minimum order set by the Trader, the amount will be shown on/or with the voucher.

  4. If you would like to place an order that is worth more than your voucher amount, you can elect to pay for the difference. If the voucher is worth more than the full order, the difference is non-refundable, it cannot also be applied to a future order; therefore for clarity, if you do not use the entire voucher amount at the time of order/transaction, the difference will be lost.

  5. Vouchers can only be used on a specific selections as denoted at the time of the offer by SSHUKL and/or the Traders. If you have any questions regarding this, or require clarification, please do not hesitate to contact us @ info@supersaverapp.co.uk

  6. Some vouchers can only be redeemed on specific items or groups of items – this will be highlighted in the offer.

  7. Special Vouchers that are targeted to ‘New Users’ can only be redeemed once.

  8. Without the permission of SUPERSAVER APP, it is not permitted to sell trade or purchase vouchers or voucher codes in any way. This also applies to purchasing vouchers or voucher codes from third parties.

  9. SUPERSAVER APP and/or its partners, Traders reserves the right to discontinue a voucher at any time or to modify any vouchers' specific terms and conditions.

  10. All discounts and offers on your SUPERSAVER APP are valid on presentation of a valid ‘e’ voucher. This voucher is within your App and will be digitally recorded and then deleted upon its one off use at the Traders premises and/or site.  Amended, Printed, photocopied or defaced vouchers will not be accepted.

  11. Present your voucher to a participating Trader to receive your redemption as described on the voucher. Unless the offer states otherwise, you may only use an offer once and the voucher will be deleted from your App.

  12. Loyalty rewards, these are in addition to the Vouchers provided. At participating partners/Traders, you will be rewarded for each transaction you undertake. You can have multiple transactions, which are recorded and stored on the App. When you reach a ‘reward’ level on each individual Trader, you can redeem these loyalty ‘stars’ within the stated Traders terms & conditions of use.  Note: Individual Traders will set their own loyalty stars thresholds and so numbers of stars required to earn a reward will vary by Trader.

USES MADE OF THE INFORMATION

SSHUKL will use information held about you in the following ways:

Information you give to SSHUKL. SSHUKL will use this information:

In the performance and administration of the Voucher and Loyalty Rewards for which you have subscribed and to provide you with the information, products and services that you request from SSHUKL; to provide you with information about other goods and services which are offered by the Trader on whose behalf SSHUKL are administering the Voucher and Loyalty Rewards; 

to provide the Trader with all information required by it in connection with the Voucher and Loyalty Rewards to which you have subscribed, including (but not limited to) for the purpose of administering your account and tracking voucher use, loyalty points and rewards earned, issued, redeemed, cancelled and other information relevant to your account; 

to notify you about changes to SSHUKL’s service, this privacy policy, or the terms of the Voucher and Loyalty Rewards; 

to ensure that any of SSHUKL’s content (whether on an Application or on any SSHUKL or Trader website) is presented in the most effective manner;

Information SSHUKL collects about you. We will use this information:

to administer the Application, SSHUKL’s website or the Trader’s website for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

to improve the Application, SSHUKL’s website or the Trader’s website to ensure that content is presented in the most effective manner for you and for your computer;

to allow you to participate in interactive features of the Voucher and Loyalty Rewards, when you choose to do so;

as part of our efforts to keep the Application SSHUKL’s website or the Trader’s website safe and secure;

to measure or understand the effectiveness of advertising which may be served via the Application, SSHUKL ’s website or the Trader’s website (where this is used to access your account);

to make suggestions and recommendations to you and other users of our site about goods or services that may interest you or them.

Information SSHUKL  receive from the Trader and other sources. SSHUKL  will combine this information with information you give to SSHUKL  and information SSHUKL  collects about you. SSHUKL  will use this information and the combined information for the purposes set out above (depending on the types of information we receive).

 

DISCLOSURE OF YOUR INFORMATION

You agree that SSHUKL  has the right to share your personal information with:

Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

the Trader who is participating in the Voucher and Loyalty Rewards on an anonymised basis.

Selected third parties including:

business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you;

advertisers and advertising networks that require the data to select and serve relevant adverts to you and others. We do not disclose information about identifiable individuals to our advertisers, but we will provide them with aggregate information about our users (for example, we may inform them that 500 men aged under 30 have clicked on their advertisement on any given day). We may also use such aggregate information to help advertisers reach the kind of audience they want to target (for example, women in SW1). We may make use of the personal data we have collected from you to enable us to comply with our advertisers’ wishes by displaying their advertisement to that target audience;

analytics and search engine providers that assist us in the improvement and optimisation of our site;

third party suppliers who are engaged by SSHUKL, in the future to connect your payment cards with rewards services or card-linked offers in connection with Transaction(s).

We will disclose your personal information to the above third parties:

In the event that we sell or buy any business or assets, in which case we will disclose your personal data (in anonymised form where you are an individual) to the prospective seller or buyer of such business or assets.

If SSHUKL or substantially all of its assets are acquired by a third party, in which case personal data held by SSHUKL about Members and the Voucher and loyalty schemes administered by it will be one of the transferred assets.

If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply the terms of the Membership Agreement and other agreements; or to protect the rights, property, or safety of SSHUKL, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

 

WHERE  SSHUKL WILL STORE YOUR PERSONAL DATA

All information you provide to SSHUKL is stored on SSHUKL’s secure servers. Where SSHUKL  has given you (or where you have chosen) a password which enables you to access your account, you are responsible for keeping this password confidential. SSHUKL  asks you not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although SSHUKL will do its best to protect your personal data, SSHUKL cannot guarantee the security of your data transmitted via an Application, SSHUKL’s website or the Trader’s website; any transmission is at your own risk. Once SSHUKL has received your information, SSHUKL  will use strict procedures and security features to try to prevent unauthorised access.

 

THIRD PARTY PROCESSORS

Your Personal Data may be processed (by third party processors engaged by SuperSaver Holdings UK Ltd) outside of the EEA

 

HOW LONG SSHUKL WILL STORE PERSONAL DATA

SSHUKL will store your Personal Data for such time as this is required in connection with your subscription to the Voucher and Loyalty Rewards.

On cancellation or termination of your subscription and/or membership to the Voucher and Loyalty Rewards SSHUKL will retain your Personal Data for a period of six (6) years from the date of termination in order to enforce or apply the terms of the Membership Agreement and other agreements; or to protect the rights, property, or safety of SSHUKL, the Trader, SSHUKL’s customers, or others.

 

YOUR RIGHTS

If you are an individual in respect of whom SSHUKL processes Personal Data, you have the following rights:

Right of access to your Personal Data

you can request a copy of the Personal Data SSHUKL processes relating to you. If your request is sent to SSHUKL electronically SSHUKL will supply this in a commonly used electronic form, unless you specifically request this in a different format.

SSHUKL will supply the data within 1 month of the date of your request free of charge. If your request is complex or numerous SSHUKL may extend this period by a further period of two months (though SSHUKL will inform you within one month of the receipt of your request if this is the case and explain why the extension is necessary).

SSHUKL reserves the right to charge a reasonable fee if you request additional copies of the information, to cover SSHUK s administration costs. If access requests are unfounded or excessive SSHUKL may charge a reasonable fee to provide the data, take the action requested, or refuse to act on the request.

Right to request the rectification of your Personal Data

SSHUKL will make every effort to ensure that Personal Data is accurate, kept up-to-date and erased or corrected without delay in the event of inaccuracies. However, in the event that you become aware that SSHUKL holds any inaccurate or incomplete Personal Data, you can send a rectification request for SSHUKL to correct any inaccurate data or to complete any incomplete data it holds.

SSHUKL will respond to a rectification request within 1 month of the date of your request. If your request is complex SSHUKL may extend this period by a further period of two months and we will let you know.

If SSHUKL intends to take no action in respect of a notification request SSHUKL shall explain this to you along with further information about your rights.

Right to request the erasure of your Personal Data (the “right to be forgotten”)

SSHUKL will not hold any Personal Data for longer than is necessary for the purposes for which it was collected. If SSHUKL holds Personal Data:

which you believe is no longer necessary for the purpose it was collected; or

you withdraw your consent to the processing; or

you object to the processing; or

which you believe is being processed unlawfully

you may request the erasure of any Personal Data held by L SSHUKL

SSHUKL will upon request erase any inaccurate Personal Data without delay unless SSHUKL needs to retain the Personal Data for any of the purposes specified in GDPR.

Right to request the restriction on processing of your Personal Data

You may request SSHUKL to restrict processing of your Personal Data:

which you believe is being unlawfully processed but where you do not want erasure;

which you believe SSHUKL no longer needs but which you wish SSHUKL to retain for the purposes of defending legal claims or other grounds specified in GDPR.

If you request a data processing restriction SSHUKL may continue to store the Personal Data, but may only process it:

with your consent;

to establish, exercise, or defend legal claims;

to protect the rights of another individual or legal entity; or

for important public interest reasons.

Right to object to SSHUKLs processing of your Personal Data

You may object to SSHUKL’s processing of your Personal Data where processing is based on public interests or legitimate interests for direct marketing.

If you object SSHUKL will stop processing the Personal Data unless SSHUKL :

has a compelling legitimate ground for processing the Personal Data that overrides your interests; or

needs to process the Personal Data to establish, exercise, or defend legal claims.

Right to data portability in respect of your Personal Data.

You have the right to request SSHUKL to:

supply your Personal Data in a commonly used and machine-readable format so that you may store it for further personal use on a private device;

transmit the Personal Data to another data controller;

transmit your Personal Data directly to another data controller to another where technically possible.

However, this portability right only applies under limited circumstances and to a limited subset of Personal Data processed by SSHUKL.

The right to data portability only applies to Personal Data:

about you. It does not apply to anonymous data or information that does not concern you.

which you have provided to SSHUKL including:

information that you have knowingly and actively provided, such as name and contact information;

information generated by and collected from your activities while using the Voucher and Loyalty Rewards or the Application, SSHUKL’s website or the Trader’s website;

which is automated and is either based on your consent or is necessary for SSHUKL to perform its obligations under the members Agreement or other contract between SSHUKL and you.

It does not apply to Personal Data that SSHUKL generates as part of its data processing undertaken in accordance with this policy or which is permitted under GDPR,

Right to notification of any breach

In the unlikely event of a Personal Data breach which is likely to result in a high risk to your rights, SSHUKL will notify you of the breach without undue delay.

However, if your Personal Data is encrypted or otherwise unintelligible SSHUKL will not be required to notify you of a breach.

SSHUKL’s website may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that SSHUKL  does not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Businesses (Traders) specific terms and Conditions;

SSHUKL and its subsidiaries provide a set of Professional and Marketing services to Traders willing to engage in the Platform that provides consumers with an interactive digital App. The App provides information and direct personalised marketing messages to encourage use of the Traders business offering, through incentives of Vouchers, offers and Loyalty rewards for everyday repeat transactions.

The Traders obtain real marketing information and insights to their customer take up of offers, Voucher use and loyalty reward build up. Access to the collective data is via a secure portal access. In addition, regular marketing of Vouchers, offers, messages and loyalty rewards can be promoted to the Traders customer base and selective targets of potentially new customers. 

 

SSHUKL will provide marketing services, such as set up of a Branded position on the App, and regular communications to the App community to drive existing and new customers to their location and/or service. A monthly report on the performance of the Offers, Vouchers, Loyalty rewards will be provided via the portal. In addition, access to the Marketing team to discuss new promotional offers regularly will be available. Brand ambassadors and virtual promoters will also drive responses and traffic and will from time to time promote Traders exclusively by pre-agreed terms.

 

PAYMENTS and Fees

  1. An initial fee to set up the Trader on the App, the local Web site and the Portal is payable upon sign up.

  2. An annual fee is clearly set out in the Order form.  The minimum term is 12 months from launch of your position on the App

  3. After the 12 month subscription is complete, rolling monthly contract will begin at £30 a month and can be cancelled by the trader with a 30 days notice.

  4. The payments can be spread by an agreed Direct Debit payment

  5. Rolling contract payments will be taken from the same card used in the first 12 month subscription with SSHUKL. 

  6. Invoices are sent electronically 

  7. There is a standard 14 day cooling off period from initial set up and order form signature – provided that the Trader has NOT gone live. The initial set up fee is non-refundable as work commences immediately upon order for preparation to load onto the platform

  8. In the event of late payment, the Company may charge interest on the amount outstanding following 15 days of non-payment. Charges will be based on BBR plus 4% charged daily until the debt is settled.

  9. If any amount of an invoice is disputed, then the Trader shall inform the SSHUKL of the grounds for such dispute within seven days. SSHUKL shall look to rectify any such disputes, within 5 working days and agree to settlement, adjustment or the invoice standing and payment shall then fall due as originally set.

  10. The SSHUKL reserves the right to increase a quoted fee if the client requests a variation to the work agreed.

     

CANCELLATION

  1. In the unlikely event of the Trader wishing to cancel, the following terms apply;

  2. An initial ‘cooling off’ period of 14 days if a telephone orders and 5 working days if signed on the premises is permitted.  However, the initial on-boarding fee is non-refundable as work to load the Traders details, brand and offers to the platform begins immediately.

  3. Post the cooling off period, any further cancellation is at the sole discretion of SSHUKL within the initial 12 month contractual period. Should such cancellation be allowed, then SSHUKL will seek to recover any costs, charges and expenses already incurred.  Cancellation of the Direct Debit payment will not be an acceptable action or position of cancellation and SSHUKL will seek to recover any sums due and outstanding.

  4. Upon termination, SSHUKL will retain all customer data, transactions and Voucher/Loyalty reward history. The reporting and marketing elements of the service will no longer be accessible.

  5. All data collected by the App around the customer behaviours and transactions remain the property of SSHUKL and the data subject as per the Data protection act and GDPR rules.  Any such breach of this data or attempts to copy, download, re-purpose or use will be reported to both the ICO and also an alert to the end user of such breach.

  6. The Trader remains liable for upholding such rules on data protection and GDPR as a joint data controller and for a period 6 years after cancellation

 

Any and all disputes are to be handled under UK Law and in the Courts of England and Wales.
